Probation Violations in Georgia: Avoid Revocation

Georgia distinguishes between technical and substantive violations. A technical violation occurs when you fail an administrative condition: not reporting to your probation officer, not paying fines on time, not completing community service. A substantive violation occurs when you commit a new crime. Substantive violations are more serious, but even technical ones can result in revocation under O.C.G.A. § 42-8-38.
A revocation hearing is NOT a criminal trial. The standard of proof is 'preponderance of the evidence,' much lower than 'beyond a reasonable doubt.' You have no right to a jury, but you do have the right to an attorney and to present evidence. The judge may continue probation, modify conditions, partially revoke, or fully revoke.
