We Protect What Matters Most: Your Family and Your Children.

Family law matters are among the most personal and emotionally difficult situations you can face. Whether it is a divorce, a custody dispute, or a domestic violence situation, you need an attorney who understands both the law and the human impact of these situations. At J. Lee & Associates, we combine legal experience with compassion.

Georgia has specific laws governing divorce, custody, child support, and other family matters. Equitable distribution of assets (not equal, but fair) under O.C.G.A. § 19-5-13, custody determinations based on the best interest of the child, and child support calculations are areas where legal representation makes a significant difference.

Our bilingual team in Norcross handles family law cases in the Superior Courts of Gwinnett County and surrounding counties. We understand the cultural nuances of the Hispanic community and offer representation that is sensitive to these needs.

What You Should Do

1

Protect Your Safety First

If you are facing domestic violence, your safety is the priority. You can request a Temporary Protective Order (TPO) under O.C.G.A. § 19-13-3 without an attorney, although we recommend having representation.

2

Document Your Situation

Keep financial records, relevant communications, and evidence of both parents' involvement in childcare. This documentation strengthens your position.

3

Don't Make Impulsive Decisions

Do not move out of the home with the children without consulting an attorney. Unilateral actions can negatively affect your custody case before the judge.

4

Consult an Attorney Before Acting

Family law is complex. Seemingly simple decisions can have significant legal consequences. Call (770) 609-9396 for an evaluation of your case.

Frequently Asked Questions about Family Law

How long does a divorce take in Georgia?
An uncontested divorce in Georgia has a minimum waiting period of 31 days after the spouse is served (O.C.G.A. § 19-5-3). A contested divorce can take 6 months to over a year, depending on disputes over assets, custody, and support.
How is child custody decided in Georgia?
The judge decides based on the 'best interest of the child' under O.C.G.A. § 19-9-3. Factors considered include the bond with each parent, home stability, parental health, and each parent's ability to foster a healthy relationship with the other. Starting at age 14, the child's preference carries significant weight; at age 11, the child may express a preference.
Do I need a lawyer for an uncontested divorce?
It is not technically required, but it is highly recommended. Even in amicable divorces, decisions about asset division, debts, and custody have lasting legal consequences. An attorney protects your long-term interests and ensures the agreement is fair.
How is child support calculated in Georgia?
Georgia uses an 'income shares' model under O.C.G.A. § 19-6-15. The gross income of both parents, the number of children, and deviations for health insurance costs, childcare, and other factors are all considered. The calculation follows a formula established by law.
