The Store's Duty of Care

Under O.C.G.A. § 51-3-1, grocery stores and other businesses that invite the public onto their property owe customers a duty of ordinary care to maintain safe premises. This includes:

  • Regularly inspecting floors and aisles for hazards
  • Promptly cleaning up spills and debris
  • Placing visible warning signs when floors are wet
  • Maintaining adequate lighting throughout the store
  • Keeping aisles clear of merchandise, boxes, and equipment
  • Repairing damaged flooring, loose tiles, and uneven surfaces

Proving the Store Knew About the Hazard

Georgia law requires you to show that the store had actual or constructive knowledge of the dangerous condition. Under O.C.G.A. § 51-3-1, constructive knowledge means the hazard existed long enough that the store should have discovered and addressed it through reasonable inspection. Evidence that helps establish this includes:

  • The condition of the spill (dried, spread, tracked through = existed for a while)
  • Employee inspection logs showing when the area was last checked
  • Whether the store had a regular floor inspection protocol and whether it was followed
  • Surveillance footage showing how long the hazard existed before your fall
  • Witness testimony that the spill was visible for an extended period

Common Causes of Grocery Store Falls

  • Liquid spills: water, juice, cooking oil, milk, broken jars
  • Produce debris: grapes, lettuce leaves, banana peels on the floor
  • Freshly mopped floors without wet floor signs or barriers
  • Leaking refrigerator or freezer cases creating puddles in aisles
  • Broken or uneven flooring (cracked tiles, torn mats, threshold transitions)
  • Cluttered aisles with merchandise, stocking carts, or boxes blocking the path
  • Parking lot hazards: potholes, ice, oil slicks, damaged curbing
  • Inadequate entrance mats during rain or snow allowing water to pool inside

What to Do After a Grocery Store Fall

  1. Report the incident to the store manager and insist on filling out an incident report. Get a copy or photograph it.
  2. Do not let the store clean up the hazard before you photograph it. Take pictures of the spill, the floor, the aisle, the absence of warning signs, and your injuries.
  3. Identify witnesses and get their contact information. Other shoppers and employees may have seen the hazard or your fall.
  4. Ask about surveillance cameras. Most grocery stores have extensive camera systems. Request that footage be preserved immediately; it may be overwritten within days.
  5. Photograph your shoes. The defense will argue your footwear was inappropriate. Document what you were wearing.
  6. Seek medical attention the same day, even if you feel only minor pain. Falls onto hard commercial floors commonly cause fractures, back injuries, and head trauma that worsen over time.
  7. Do not give a recorded statement to the store's insurance company without consulting an attorney.

Georgia's Comparative Negligence Defense

Under O.C.G.A. § 51-12-33, the store will argue comparative negligence, claiming you were partially at fault for not watching where you walked, wearing improper footwear, or ignoring warning signs. Georgia's modified comparative negligence rule reduces your recovery by your percentage of fault and bars recovery entirely if you are 50% or more at fault.
