Parking lot pedestrian accidents are more common and more serious than most people realize. Driver Duty of Care

Under O.C.G.A. § 40-6-144, drivers must exercise due care to avoid colliding with any pedestrian. This duty applies on public roads and in private parking lots alike. Georgia courts have consistently held that drivers in parking areas must operate at reduced speeds and maintain heightened awareness of pedestrians.

Property Owner Liability

Under O.C.G.A. § 51-3-1, the property owner or business operating the parking lot may also bear liability if dangerous conditions contributed to the accident. Missing or faded crosswalk markings, burned out lighting, potholes, obstructed sightlines from poorly placed dumpsters or landscaping, and missing stop signs can all create premises liability claims against the property owner in addition to claims against the driver.

Comparative Negligence

Georgia's modified comparative negligence rule under O.C.G.A. § 51-12-33 applies. If you as the pedestrian were partially at fault, for instance by walking while looking at your phone, jaywalking, or darting between parked cars, your recovery will be reduced by your percentage of fault. If your fault reaches 50% or more, you cannot recover damages.

  3. Document everything: photographs of the scene, your injuries, vehicle damage, lot conditions, and any surveillance cameras.
  4. Ask nearby businesses if they have security camera footage. This footage gets overwritten quickly, so request preservation immediately.
  5. See a doctor within 24 hours even if you feel okay. Many injuries from being struck manifest hours or days later.
