Parking Lot Accident Liability in Georgia

Parking lot accidents are far more common than most drivers realize. The Insurance Institute for Highway Safety estimates that roughly 20 percent of all vehicle accidents occur in parking lots and parking structures. While these collisions typically happen at lower speeds than highway crashes, they can still result in significant injuries, especially to pedestrians. At J. How Parking Lot Accidents Happen

Parking lots present unique hazards because of limited visibility, tight spaces, and the presence of pedestrians moving between vehicles. The most common types of parking lot accidents include:

  • Backing out collisions: Two drivers reversing out of adjacent parking spaces at the same time, or a driver backing into a vehicle traveling through the lane
  • Pulling out into traffic lanes: A driver exiting a parking space without checking for oncoming vehicles in the parking lot lane
  • Intersection conflicts: Many parking lots have unmarked or poorly marked intersections where drivers must yield but fail to do so
  • Pedestrian strikes: Drivers striking shoppers, employees, or children walking through the parking lot. Pedestrians in parking lots are especially vulnerable because they often walk between parked cars where drivers cannot see them
  • Door dings and sideswipes: Careless opening of vehicle doors or failure to maintain lane position in narrow parking aisles
  • Speed-related crashes: Drivers traveling too fast for parking lot conditions, particularly near store entrances and crosswalks

Determining Liability in Georgia Parking Lot Accidents

Liability in parking lot accidents depends on the specific circumstances of the collision. Georgia negligence law requires proving four elements: duty of care, breach of that duty, causation, and damages. Several principles commonly apply to parking lot cases:

Right-of-way rules: Under Georgia traffic law (O.C.G.A. § 40-6-70 through § 40-6-74), drivers in a through lane generally have the right of way over drivers pulling out of parking spaces or backing out of spaces. A driver who exits a parking space has an obligation to yield to traffic already in the lane.

Backing driver liability: O.C.G.A. § 40-6-240 requires that a driver shall not back a vehicle unless such movement can be made with safety and without interfering with other traffic. This means a driver who backs out of a space and strikes another vehicle or a pedestrian will generally be found at fault.

Shared fault situations: Many parking lot accidents involve shared fault. For example, if both drivers were backing out of opposing parking spaces simultaneously, both may bear some responsibility. Georgia's modified comparative negligence rule under O.C.G.A. § 51-12-33 allows recovery as long as the injured party is less than 50 percent at fault, with the recovery reduced by the injured party's percentage of fault.

Pedestrian right of way: Georgia law generally requires drivers to exercise due care to avoid colliding with pedestrians (O.C.G.A. § 40-6-93). In parking lots, this duty is heightened because drivers should reasonably expect pedestrians to be present. However, pedestrians also have a duty not to suddenly leave a place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard (O.C.G.A. § 40-6-92).

Property Owner Liability for Parking Lot Conditions

In some cases, the property owner or management company may share liability for a parking lot accident. Under Georgia premises liability law (O.C.G.A. § 51-3-1), property owners owe a duty to keep their property in a reasonably safe condition for invitees, which includes customers using the parking lot. Property owners may be liable if:

  • Faded or missing lane markings created confusion about traffic flow
  • Broken or absent lighting made it difficult for drivers to see pedestrians or other vehicles
  • Potholes or uneven pavement caused a driver to lose control
  • Obstructed sight lines from landscaping, signage, or structural elements prevented drivers from seeing oncoming traffic or pedestrians
  • Missing or inadequate stop signs, speed bumps, or directional arrows at parking lot intersections
  • Failure to maintain proper drainage, leading to standing water or ice in the lot

Pursuing a claim against a property owner requires demonstrating that the owner knew or should have known about the hazardous condition and failed to correct it within a reasonable time.

Injuries from Parking Lot Accidents

While parking lot speeds are typically lower than roadway speeds, injuries can still be serious, particularly for pedestrians:

  • Whiplash and cervical spine injuries from rear-end impacts at even low speeds
  • Broken bones, particularly wrists and arms when pedestrians brace for impact
  • Knee, hip, and pelvic injuries when a pedestrian is struck by a vehicle bumper
  • Head injuries from falling to the pavement after being struck by a vehicle
  • Back and shoulder injuries from the jarring force of a collision
  • Ankle and foot injuries from being run over by a vehicle wheel

Evidence Preservation in Parking Lot Cases

Parking lot accidents require prompt evidence gathering because critical evidence can disappear quickly:

  • Surveillance footage: Most commercial parking lots have security cameras. This footage is routinely overwritten within days or weeks. An attorney can send a preservation letter to the property owner to prevent destruction of this evidence.
  • Witness information: Other shoppers who witnessed the accident may be difficult to locate later. Collect their names and phone numbers at the scene.
  • Photographs: Document vehicle positions, damage, the parking lot layout, signage, lane markings, and any hazardous conditions.
  • Police report: While police may not always respond to parking lot accidents, requesting a report creates an official record of the incident.
