Types of Nursing Home Abuse in Georgia
Physical Abuse
Any non-accidental use of physical force that results in injury, pain, or impairment. This includes hitting, pushing, kicking, restraining, and rough handling during transfers or bathing. Under O.C.G.A. § 30-5-3, physical abuse of a disabled adult or elder person is a crime.
Neglect
The failure to provide necessary care, supervision, or services. Neglect is the most common form of nursing home mistreatment and includes:
- Failure to prevent pressure ulcers (bedsores) through regular repositioning
- Malnutrition and dehydration from inadequate feeding assistance
- Failure to administer medications correctly or on schedule
- Ignoring call lights and leaving residents in soiled clothing or bedding
- Inadequate fall prevention despite known fall risk
- Failure to provide wound care, leading to infections
Emotional and Psychological Abuse
Verbal threats, intimidation, humiliation, isolation, and ignoring residents. While harder to detect, emotional abuse causes serious psychological harm and is often a precursor to physical abuse.
Financial Exploitation
Under O.C.G.A. § 30-5-8, exploiting a disabled adult or elder person by taking their money, property, or assets through deception, intimidation, or undue influence is a felony in Georgia.
Sexual Abuse
Any non-consensual sexual contact with a nursing home resident, including residents with dementia who cannot consent.

- Unexplained bruises, cuts, burns, or fractures
- Pressure ulcers (bedsores), particularly in advanced stages
- Sudden weight loss, dehydration, or malnutrition
- Poor hygiene, soiled clothing, or unchanged bedding
- Emotional withdrawal, fear of staff, or agitation when certain caregivers are present
- Unexplained changes in financial accounts or missing personal belongings
- Frequent infections, especially urinary tract infections from inattentive catheter care
- Medication errors or over-sedation ("chemical restraint")
- Facility reluctance to allow private visits
Georgia Laws Protecting Nursing Home Residents

Under O.C.G.A. § 31-8-100 et seq., nursing home residents have specific rights including the right to be free from abuse and neglect, the right to adequate and appropriate medical care, the right to privacy, the right to manage their own financial affairs, and the right to voice grievances without retaliation.
Mandatory Reporting
Under O.C.G.A. § 30-5-4, healthcare workers, social workers, and certain other professionals are mandatory reporters of elder abuse. Failure to report suspected abuse is a misdemeanor.
Statute of Limitations
Personal injury claims must be filed within two years under O.C.G.A. § 9-3-33. Wrongful death claims also have a two-year deadline under O.C.G.A. § 51-4-1. For financial exploitation, the deadline may vary depending on when the exploitation was discovered.
