Intersection Car Accidents in Georgia: Right-of-Way Laws and Liability

Georgia's right-of-way statutes establish clear rules for who must yield at intersections. Under O.C.G.A. § 40-6-70, a driver approaching an intersection must yield the right of way to any vehicle that has already entered the intersection. At uncontrolled intersections (those without traffic signals or stop signs), O.C.G.A. § 40-6-71 requires the driver on the left to yield to the driver on the right when both vehicles arrive at approximately the same time.
For intersections controlled by stop signs, O.C.G.A. § 40-6-72 mandates that a driver who has stopped must yield the right of way to any vehicle in the intersection or approaching so closely as to constitute an immediate hazard. When making left turns at intersections, O.C.G.A. § 40-6-71 requires the turning driver to yield to all vehicles approaching from the opposite direction that are close enough to present an immediate hazard.
Drivers entering a roadway from a private driveway, alley, or parking lot must yield to all traffic on the roadway under O.C.G.A. § 40-6-73. Violations of any of these statutes constitute negligence per se, meaning the violation itself establishes the fault element of a personal injury claim.
Red Light and Stop Sign Violations
Running a red light is a violation of O.C.G.A. § 40-6-20, which requires drivers to obey all traffic control devices. Red light accidents frequently produce T-bone (broadside) collisions, which are among the most dangerous crash types because the side of a vehicle offers minimal structural protection for occupants. These crashes commonly result in traumatic brain injuries, spinal cord damage, broken ribs and pelvis fractures, internal bleeding and organ damage, and fatal injuries.
Georgia courts consistently hold that a driver who runs a red light is presumed negligent. However, the at-fault driver's insurance company may attempt to argue that the light was yellow or that the victim entered the intersection prematurely. Traffic camera footage, witness testimony, and signal timing data are critical evidence in these disputes.
Types of Intersection Collisions
Different intersection crash configurations carry different injury profiles and liability considerations. T-bone collisions occur when one vehicle strikes the side of another, typically when a driver runs a red light or stop sign or fails to yield during a left turn. These are extremely dangerous for passengers on the struck side. Head-on collisions at intersections happen when a driver making a left turn misjudges the speed of oncoming traffic or when a driver drifts into the opposing lane. Rear-end collisions occur when a following driver fails to stop in time at a red light or stop sign. Multi-vehicle pileups at busy intersections can involve three or more vehicles and create complex liability scenarios requiring thorough investigation.
Determining Fault in Intersection Accidents
Georgia follows a modified comparative negligence system under O.C.G.A. § 51-12-33. A victim can recover damages as long as they are less than 50 percent responsible for the accident. The recovery amount is reduced by the victim's percentage of fault. For example, if a jury determines that the victim suffered $100,000 in damages but was 20 percent at fault for entering the intersection too quickly, the victim would recover $80,000.
Key evidence in intersection accident cases includes traffic camera and red light camera footage, surveillance video from nearby businesses, witness statements from other drivers and pedestrians, police accident reports with officer observations, vehicle damage patterns indicating point and angle of impact, electronic data recorder (black box) information from both vehicles, and signal timing records from the local traffic department.
