How Pain and Suffering Compensation Works in Georgia Personal Injury Cases

When you are injured because of someone else's negligence, Georgia law entitles you to compensation for more than just your medical bills. You may also recover non-economic damages for the physical pain, emotional anguish, and diminished quality of life caused by your injuries. Understanding how pain and suffering damages work can help you make informed decisions about your claim.

What Are Pain and Suffering Damages?

Pain and suffering is a category of non-economic damages that compensates you for subjective, intangible losses. Georgia courts recognize two primary types:

  • Physical pain and suffering: The actual pain you experienced during the injury, throughout treatment, and into the future if your condition is permanent or chronic
  • Mental and emotional distress: Anxiety, depression, fear, loss of sleep, post-traumatic stress disorder (PTSD), and other psychological consequences of your injury

Additional related damages include loss of enjoyment of life (the inability to participate in activities you previously enjoyed) and loss of consortium (the impact on your relationship with your spouse).

How Georgia Courts Calculate Pain and Suffering

Unlike medical bills, pain and suffering cannot be measured with a receipt. Georgia juries have broad discretion in awarding these damages. Two common methods are used to estimate a fair value:

Multiplier Method

The total economic damages (medical bills, lost wages) are multiplied by a factor, typically between 1.5 and 5, depending on the severity and permanence of your injuries. A more serious, permanent injury warrants a higher multiplier.

Per Diem Method

A daily dollar amount is assigned to your pain and suffering, and that amount is multiplied by the number of days you have suffered or are expected to suffer. For example, $200 per day for 500 days of recovery and pain equals $100,000 in non-economic damages.

Georgia Law: No Cap on Most Pain and Suffering Awards

Georgia does not impose a statutory cap on pain and suffering damages in most personal injury cases. The Georgia Supreme Court struck down non-economic damage caps in Atlanta Oculoplastic Surgery v. Nestlehutt, 286 Ga. 731 (2010), holding that such limits violated the Georgia Constitution's right to jury trial. However, caps do apply in limited contexts, including medical malpractice cases where punitive damages are at issue.

Comparative Negligence and Your Award

Under O.C.G.A. § 51-12-33, Georgia uses a modified comparative negligence system. If you are found partially at fault for your own injury, your total damages, including pain and suffering, are reduced proportionally. If you are 20% at fault, you recover 80% of your total damages. If you are 50% or more at fault, you recover nothing. Insurance adjusters often try to inflate your share of fault precisely to reduce or eliminate your non-economic award.

  • Whether the injuries are permanent or result in ongoing limitations
  • How consistently you sought and followed medical treatment
  • Documented impact on your daily life (journals, testimony from family and friends)
  • Expert medical testimony on future pain and functional limitations
