How to File a Bond Reduction Motion for a Felony Charge in Georgia
Being held in jail awaiting trial is one of the most devastating consequences of a felony arrest in Georgia. Even if you are ultimately found not guilty, spending months in jail can cost you your job, your housing, and your family stability. Filing a bond reduction motion is often the fastest way to secure pretrial release for defendants who cannot afford the bond originally set. At J. How Bond Is Set in Georgia
In Georgia, bond for felony charges is typically set by a Superior Court judge at the defendant's first appearance or bond hearing. Under O.C.G.A. § 17-6-1, many felony charges are non-bailable by a magistrate court and require a Superior Court judge to set or modify bond. Certain serious charges, including violent felonies, murder, kidnapping, armed robbery, and drug trafficking, require a Superior Court order before bond can be considered at all.
Grounds for a Bond Reduction Motion
Georgia courts consider four factors when evaluating bond, set out in O.C.G.A. § 17-6-1(e):
- The charge: The nature and circumstances of the offense alleged
- Flight risk: The defendant's ties to the community, employment history, length of Georgia residence, and family relationships that make them likely to appear for court
- Criminal history: Prior convictions, failures to appear, or prior bond violations
- Public safety: Whether releasing the defendant would pose a risk to the alleged victim or the community
A bond reduction motion argues that the original bond was set too high relative to these factors, and asks the court to lower it to an amount the defendant can afford.
How to Present a Compelling Bond Reduction Argument
Winning a bond reduction requires presenting specific, credible evidence that cuts against the flight risk and dangerousness concerns. Effective arguments include:
- Community ties: Length of residence in Georgia, family members in the area (especially minor children), stable employment history
- Employment: Employer letter confirming job and willingness to continue employing the defendant upon release
- Alternative release conditions: Offering to submit to electronic monitoring (ankle bracelet), drug testing, passport surrender, or regular check-ins with pretrial services as conditions of a lower bond
- Clean record: No prior criminal history or failures to appear
- Family support: Family members who can testify to the defendant's ties and support network
- Health issues: Medical conditions that make incarceration dangerous and require community-based treatment
The Bond Reduction Hearing Process
- File a formal Motion for Bond Reduction in the Superior Court of the county where charges are pending. The motion must cite the legal standard and present the factual grounds for reduction.
- Serve the motion on the District Attorney's office. The DA has an opportunity to respond and object at the hearing.
- Appear at the bond hearing. The defense presents evidence and argument. The State may present evidence of dangerousness or prior failures to appear. In some counties, law enforcement and alleged victims may also be heard.
- The judge issues a ruling from the bench or in writing, setting a new bond amount or denying the reduction.
What Happens If Bond Reduction Is Denied?
If the Superior Court denies bond reduction, additional options include:
- Seeking an appeal or writ of habeas corpus in the Georgia Court of Appeals or Supreme Court
- Requesting that the case be set for an early trial date, which can reduce the overall period of pretrial detention
- Presenting new evidence or changed circumstances in a subsequent motion
