Construction Zone Car Accidents in Georgia: Your Legal Rights

Georgia's highways and roads see constant construction activity, particularly along major corridors like I-85, I-75, I-285, and GA-400. Construction zones create hazardous driving conditions with lane shifts, reduced speeds, narrow lanes, uneven pavement, and heavy equipment operating near traffic. When accidents happen in these zones, injuries tend to be more severe and liability questions more complex.

J. Lee & Associates Law Group represents drivers, passengers, and construction workers injured in work zone accidents across metro Atlanta and throughout Georgia.

Georgia Construction Zone Traffic Laws

Enhanced Penalties and Fines

Georgia law takes work zone safety seriously. Under O.C.G.A. § 40-6-188, fines for speeding in a work zone are doubled when workers are present. Under O.C.G.A. § 40-6-56, drivers must exercise increased caution in construction areas and obey all posted work zone speed limits, flaggers, and signage. Failure to do so constitutes negligence per se in a personal injury case, meaning the violation itself establishes the driver's fault.

Move Over Law

Under O.C.G.A. § 40-6-16, Georgia's Move Over law requires drivers to change lanes or slow down when approaching construction vehicles with flashing lights on the roadside. Violations that result in accidents can establish clear liability for the at-fault driver.

Common Causes of Construction Zone Accidents

  • Speeding through reduced speed zones
  • Distracted driving in areas requiring heightened attention
  • Tailgating due to sudden traffic slowdowns at zone entry points
  • Improper lane merging at lane closures
  • Inadequate signage or warning by the construction company
  • Defective traffic control devices: missing cones, non-functioning message boards, confusing lane markings
  • Uneven road surfaces, loose gravel, steel plates, or exposed drainage
  • Construction equipment entering traffic lanes without proper flagging
  • Nighttime construction with insufficient lighting

Who Is Liable for Construction Zone Accidents?

Multiple parties may bear responsibility:

  • Other drivers who drove negligently through the work zone
  • The construction company responsible for setting up and maintaining safe traffic control
  • Subcontractors who performed specific work creating the hazard
  • The Georgia Department of Transportation (GDOT) if the state failed to approve or inspect proper work zone plans
  • Equipment manufacturers if defective vehicles or machinery caused the crash
  • Traffic control subcontractors responsible for signage, cones, and flagging

Claims Against Government Entities

Filing a claim against GDOT or a local government agency in Georgia requires compliance with the Georgia Tort Claims Act, O.C.G.A. § 50-21-20 et seq. Sovereign immunity is waived for certain negligent acts, but strict procedural requirements apply, including ante-litem notice within 12 months of the incident. Missing this deadline can bar your claim entirely.

Injuries Common in Work Zone Crashes

Construction zone accidents often involve rear-end collisions at high speeds when traffic stops suddenly. Common injuries include:

  • Traumatic brain injuries
  • Spinal cord injuries and paralysis
  • Multiple fractures from high-impact collisions
  • Whiplash and soft tissue injuries
  • Burns from vehicle fires or chemical spills
  • Crush injuries when vehicles are pushed into barriers or equipment

Compensation and Deadlines

Under O.C.G.A. § 9-3-33, the statute of limitations for personal injury claims is two years. Claims against government entities have shorter notice deadlines under the Tort Claims Act. Recoverable damages include medical expenses, lost wages, pain and suffering, and in cases of extreme negligence, punitive damages under O.C.G.A. § 51-12-5.1.
