I-130 Processing Times and Expedite Requests in 2026: What Families Need to Know
The Form I-130, Petition for Alien Relative, is the foundational document that starts the family-based immigration process. Whether you are a U.S. citizen petitioning for a spouse, parent, child, or sibling, or a lawful permanent resident petitioning for a spouse or unmarried child, understanding current processing times and when to request expedited handling is essential. At J. Lee & Associates Law Group, we guide families in Georgia through every step of the I-130 process.
Current I-130 Processing Times in 2026
USCIS processing times vary significantly by the petitioner's relationship to the beneficiary and the specific service center handling the case. As of mid-2026, typical processing times include:
- U.S. citizen petitioning for spouse (immediate relative): 10 to 18 months at most field offices; some service centers process faster
- U.S. citizen petitioning for parent or unmarried child under 21: 12 to 20 months
- U.S. citizen petitioning for married child or adult child (F3/F1 preference): Several years due to visa backlogs for oversubscribed countries
- U.S. citizen petitioning for sibling (F4 preference): Decades in many cases for nationals of high-demand countries
- LPR petitioning for spouse or unmarried child under 21 (F2A): 2 to 4 years currently; priority date movement varies monthly per the Visa Bulletin
[VERIFY - dated 2026-05] Processing times change frequently. Always check the USCIS website at uscis.gov/tools/check-case-processing-times for the current estimate for your specific form and service center.
How to Check Your I-130 Status
- USCIS online account: Create or log into your myUSCIS account at uscis.gov to check case status and receive notices electronically
- Receipt notice (I-797): Use the receipt number from your I-797 notice to track your case
- E-Request inquiry: If your case is outside normal processing times, submit an e-Request through the USCIS website
- Congressional inquiry: Your U.S. Representative or Senator's office can submit a status inquiry to USCIS on your behalf
Requesting an Expedite on Your I-130
USCIS may expedite an I-130 petition in limited circumstances. The standard for expediting is high, and approval is not guaranteed. USCIS considers expedition requests based on:
- Severe financial loss to a company or person, such as impending contract deadlines or business closure
- Urgent humanitarian reasons, including terminal illness of the petitioner or beneficiary, medical crises requiring the family member's presence, or care for a severely ill U.S. citizen
- Compelling U.S. government interest, such as support from a government agency
- Clear USCIS error that caused the delay
- Nonprofit organization requests furthering social interests
To request an expedite, submit a detailed letter to USCIS explaining the basis for the request with supporting documentation. USCIS typically responds within 30 to 60 days. The expedite request must be submitted after the I-130 has been pending longer than the published processing time.
The Visa Bulletin and Priority Dates
For preference category relatives (not immediate relatives of U.S. citizens), an approved I-130 petition does not mean immediate eligibility to apply for a visa or adjust status. The beneficiary must wait for their priority date to become current according to the monthly Visa Bulletin published by the U.S. Department of State.
The priority date is the date USCIS received the I-130 petition. When the Visa Bulletin shows a date current for your country of birth and preference category, you may proceed to the next step: either apply for an immigrant visa at a U.S. consulate or, if you are in the U.S., file Form I-485 to adjust status.
