What Is Whiplash?

Whiplash is a neck injury caused by a rapid back-and-forth movement of the head, similar to the cracking of a whip. It most commonly occurs in rear-end car accidents but can also result from sports injuries, falls, and other trauma. Despite its frequent dismissal as a minor injury, whiplash can cause:

  • Neck pain and stiffness, often worsening in the days following the accident
  • Loss of range of motion in the neck
  • Headaches starting at the base of the skull
  • Shoulder, upper back, and arm pain
  • Tingling or numbness in the arms
  • Fatigue, dizziness, and blurred vision
  • Cognitive difficulties, including memory and concentration problems
  • Chronic pain lasting months or years in severe cases

How Insurance Companies Dispute Soft Tissue Claims

Insurance adjusters are trained to minimize the value of whiplash and soft tissue injury claims. Common tactics include:

  • Arguing injuries are pre-existing: Any prior back, neck, or shoulder issues become a target for blame
  • Disputing causation: Claiming the accident was too minor to cause the reported injuries, often based on minimal vehicle damage
  • Delaying treatment gaps against you: If you did not seek immediate medical care, they may argue your injuries were not serious

  • Seek medical care immediately after the accident, even if symptoms seem mild. Symptom onset for whiplash can be delayed 24 to 48 hours.
  • Follow your treatment plan precisely. Gaps in care give insurers ammunition to argue your injuries resolved.
  • Request MRI imaging. While X-rays miss soft tissue damage, MRI can reveal disc injuries, ligament tears, and nerve compression.
  • Keep a symptom journal. Daily notes about your pain levels and how your injuries affect work, sleep, and daily activities create a compelling record for negotiations and trial.
  • Seek specialist referrals to orthopedic surgeons, pain management specialists, or physical therapists as appropriate.

Georgia Law and Soft Tissue Claims

Georgia's modified comparative negligence statute (O.C.G.A. § 51-12-33) applies to all personal injury claims, including soft tissue injuries. You may recover full compensation so long as your share of fault is less than 50%. The statute of limitations under O.C.G.A. § 9-3-33 gives you two years from the accident date to file a lawsuit.
